ARNPs United Legislative Update
The 2015 Washington State Legislature’s 105 day session has passed the half-way point.  All policy bills were required to be voted out of the house of origin by March 11; those that were not are effectively dead for the session. 
 
ARNPs United of Washington State is excited HB 1259 ARNP Global Signature legislation unanimously passed the House Representatives on February 9 and was one of the first House bills to receive a public hearing by the Senate Committee on Health Care March 12 where it was positively received.  The legislation, if passed, would allow ARNPs to sign all forms for patients as long as the care is within the ARNPs scope of practice.  The bill reads:

Adding a new Chapter to RCW 18.79, the Washington Nurse Practice Act to state:
“An advanced registered nurse practitioner may sign and attest to any certificates, cards, forms, or other required documentation that a physician may sign, so long as it is within the advanced registered nurse practitioner's scope of practice.”

ARNPs United’s Legislative Committee has also chosen which bills to promote, which to support or monitor and which to oppose. Examples of the many bills we are supporting include:

Amending a bill to require the Health Technology Assessment program’s clinical committee to have a designated ARNP member
Increased funding for the health professional loan repayment program
Enhanced Medicaid reimbursement for ARNP primary care services
Education funding for nurse educators
Reimbursement for telehealth
Access to naloxone for individuals who use opioids as well as their friends and family
WSNA’s patient safety and safe staffing for RNs.

 opposed legislation requiring parental notification for minors seeking pregnancy termination and expressed concerns about legislation allowing the Secretary of the Department of Health to limit the scope of practice for health disciplines.
 
ARNPs United has been contacted to oppose 2SSB 5052 which will significantly reform the state’s medical marijuana law and align aspects of it with the state’s recreational marijuana laws.  ARNPs United supports access to a wide array of evidence-based care options for patients, one of which may be medical marijuana.  Washington State is the least regulated of the 23 states and District of Columbia that allow medical marijuana.  Without a patient registry, there is no data regarding the number of medical marijuana patients and the types of conditions for which they receive an authorization. 
 
There have been notable cases of providers not following the law when authorizing people as medical marijuana patients. Combined with the state’s tolerance of illegal dispensaries, it is unclear that the intent of the original medical marijuana act in 1998 to provide compassionate care to people with terminal and debilitating conditions has been upheld. 
In the end, it seems the public has been asked to tolerate an unregulated system with illegal aspects that serves the many who are not legitimate patients while those who are may end up suffering.
 
Restrictions in the US have limited research of a high level and quality of evidence.   Many studies cited as evidence to support medical marijuana are poor quality and have severe limitations. At this time, ARNPs United supports SB 5121 to promote research on medical marijuana.  In it’s position paper on medical marijuana, the Washington Osteopathic Medical Association states:  “We are concerned with the lack of quality clinical research in the area of medical marijuana. At present there is no consistent strength, dosing schedule or delivery system of medical marijuana, as there is with legend medications…further controlled trials, as with any other medication, must be the benchmark for evaluating therapeutic risks and benefits.”
Furthermore, in Washington we currently have no rules regulating the production and safety of marijuana products. The current proposed legislation, 2SSB 5052 states  “While medical needs remain, the state is in the untenable position of having a recreational product that is tested and subject to production standards that ensure safe access for recreational users. No such standards exist for medical users and, consequently, the very people originally meant to be helped through the medical use of marijuana do not know if their product has been tested for molds, do not know where their marijuana has been grown, have no certainty in the level of THC or CBD in their products, and have no assurances that their products have been handled through quality assurance measures. It is the public policy of the state to allow qualifying patients to only have access to products that may be endangering their health.”
ARNPs have an obligation is to deliver safe, effective, evidence-based care to our patients. ARNPs United continues to urge all health care providers who choose to authorize patients for use of medical marijuana to follow the law, Title 69 Chapter 69.51A RCW Medical Marijuana, which can be accessed at http://apps.leg.wa.gov/RCW/default.aspx?cite=69.51A&full=true <http://apps.leg.wa.gov/RCW/default.aspx?cite=69.51A&full=true>.  Standards of care in the Nurse Practice Act must also be followed. 
 
At this time, ARNPs United does not have a specific position on 2SSB 5052.  ARNPs United does encourage all ARNPs to use high quality evidence, follow the laws, protect patients and protect their license.
