Steve: New York can call elephants ducks, and bikes trucks but it still
does not change one bit the fundamental differences the rest of the country
acknowledges, and collectively understands is the practice of medicine.
Apparently the NY laws are written as they are to protect the turf of
physicians (as in all States really) and to keep the public believing that
no one else can possibly do what doctors do. Times will change if NY NPs and
PAs get up on their hind legs a make some noise. They need to assert
themselves as "medical providers", "health care providers", "Advance
Practice Clinicians", just like they are practicing medicine (the way it
should be practiced- economically, high availability, efficiently, etc.),
not nursing, not witchcraft, and certainly not giving the public a service
which is in any way less than what the doctors provide to the public.

I agree that this is basically semantics. However, I merely cut and pasted
from the NYS DOE website their legal definition a Nurse Practitioner. I
have a
hard time with folks challenging this!
The following is their legal definition of "medicine:" Article 131
§6520. Introduction.
This article applies to the profession of medicine.
§6521. Definition of practice of medicine.
The practice of the profession of medicine is defined as diagnosing,
treating, operating or prescribing for any human disease, pain, injury,
deformity or
physical condition.
§6522. Practice of medicine and use of title "physician".
Only a person licensed or otherwise authorized under this article shall
practice medicine or use the title "physician".
So as I stated previously, NP's in NY technically do not practice
"medicine."
The last time that I checked, my license falls under nursing article 139,
not medicine 131.
I have also pasted the definition under article 131-B for PA's (there is
that phrase again, "medical services"):
§6542. Performance of medical services.
1. Notwithstanding any other provision of law, a physician assistant
may
perform medical services, but only when under the supervision of a
physician
and only when such acts and duties as are assigned to him are within the
scope of practice of such supervising physician.
Again, I am merely interpreting the laws as they are literally written. I
welcome anyone to show me where it explicitly states that NP's "practice
medicine."
