I would have to say...if a class action suit were to develop over these issues it would have to come from one state where it can be shown that: it impairs the ability to earn money, is not in accordance with the State laws for the NP, it keeps NPs/PAs invisible to not only the public but to insurers...a whole list of issues surround this (not an easy case to develop)....there are good cases (not NP) surrounding restraint of trade issues...whether this would be setting a precedent...I do not know...maybe some of the NP/Attorneys on this listserv could answer this one? and whether AANP/ACNP would tackle such a case? I don't have the answer to that either...what I do know is that this is an issue...which impacts our ability to earn money...and as others have said all along...this will always be about money and economics....not matter what the language...or buzz words...."safety", "patients need a doctor because of their training"...all those scare
tactics the AMA uses to defend their turf.... Meg (Portland Oregon)
